To the best of my knowledge, operation on
SSB by Canadian amateurs in the portion of 40 Meters that you mention is permitted by their regulations. I don't believe that said regulations assign portions of the various amateur bands by mode. You might contact the ARRL (I assume you're a member) and see if they have discusssed this matter with RAC, the counterpart organization in Canada.
It may be that the situation will improve when short wave broadcasting is moved out of much of the 40 Meter band. I believe that the ITU has decided that the amateur allocation worldwide will be expanded to 200 KHz in the future.
